Performance & Illustration Disclaimer

Effective date: 9/1/26 Last updated: 9/9/26

This disclaimer applies to all figures, charts, examples, illustrations, hypothetical scenarios, index references, and product descriptions appearing anywhere on demarcoretirementpartners.com, including landing pages, forms, downloadable guides, and video content.

1. Nothing Here Is a Prediction

Any number shown on this Site is illustrative. It is not a projection, forecast, estimate, promise, or guarantee of what any product will do, what any index will do, or what your results will be.

Hypothetical examples are used to explain how a product mechanism works — not to suggest a likely outcome. Your actual results will differ, and may differ substantially.

2. Past Performance

Past performance of any index, market, product, or strategy is not a guarantee or indication of future results. Historical index data shown for educational purposes reflects what an index did over a stated period; it does not reflect what any specific annuity or life insurance policy credited over that period, and it does not predict future crediting.

Where historical index data is shown, it is provided by the index sponsor or the issuing carrier. We do not independently verify it.

3. Indices Are Not Investments

You cannot invest directly in a market index.

Fixed indexed annuities and indexed universal life policies are insurance contracts, not investments, and they do not participate in the market. Purchasing an indexed insurance product does not mean you own stocks, shares, mutual funds, or any interest in the index or its underlying components.

Index-linked crediting is calculated according to a formula defined in the policy contract, and is limited by features including caps, participation rates, spreads, margins, averaging methods, and crediting terms. These features are set by the issuing carrier, vary by product and by index, and are generally subject to change by the carrier at the end of each crediting term, within contractual minimums.

Index-linked crediting typically excludes dividends paid by the index's underlying components. This can result in credited interest that is meaningfully lower than the total return of the index itself.

Some indices used in insurance products are proprietary, volatility-controlled, or have limited or hypothetical (back-tested) performance history. Back-tested data is not actual performance and was constructed with the benefit of hindsight.

4. Guaranteed and Non-Guaranteed Elements

Product illustrations contain both guaranteed and non-guaranteed elements.

Non-guaranteed elements — including current interest rates, caps, participation rates, spreads, bonus amounts, cost of insurance charges, expense charges, and dividend scales — are based on the carrier's current assumptions and can be changed by the carrier at its discretion, subject to contractual minimums and maximums.

An illustration showing non-guaranteed values is not a representation that those values will occur. Only the guaranteed columns of an illustration reflect the minimum the carrier is contractually obligated to provide.

5. Guarantees Come From the Carrier

All guarantees, benefits, and payment obligations are the contractual obligations of the issuing insurance carrier and are subject solely to that carrier's financial strength and claims-paying ability.

Guarantees are not provided by DeMarco Retirement Partners, by Ken DeMarco, by any index, or by any bank, credit union, or government agency.

Insurance and annuity products are not deposits, are not FDIC or NCUA insured, are not guaranteed by any federal or state government agency, and are not bank or credit union guaranteed.

6. Liquidity, Surrender Charges, and Fees

Annuity and life insurance contracts are long-term products designed to be held for the duration of the contract term.

Withdrawals may be subject to surrender charges, market value adjustments, loss of bonus or interest credits, and reduction or forfeiture of rider benefits. Withdrawals may reduce the account value, death benefit, and any income base. Early withdrawal can result in receiving less than the total premium paid.

Riders and optional benefits generally carry additional annual charges that are deducted from the contract regardless of whether the benefit is exercised, and that can reduce account value and credited interest.

Premium or interest bonuses, where offered, may be subject to vesting schedules or recapture upon early surrender, and products offering bonuses may carry lower caps, lower participation rates, higher spreads, or longer surrender periods than comparable products without them.

7. Income Riders and Income Base Values

Where a guaranteed lifetime income rider is discussed, any "roll-up rate," "guaranteed growth rate," or "bonus" applied to an income base, benefit base, or similar value applies only to that hypothetical accounting value used to calculate future income payments.

It is not interest credited to your account value. It is not cash you can withdraw, surrender, annuitize at will, or leave to a beneficiary as a lump sum. The income base and the account value are different numbers and generally will not be equal.

Lifetime income amounts depend on the contract terms, your age at election, payout factors set by the carrier, and continued compliance with rider conditions.

8. Indexed Universal Life

Indexed universal life is life insurance, not a savings or retirement account. It is appropriate only where there is a genuine need for a death benefit.

IUL illustrations are subject to the illustrated rate limitations imposed by NAIC Actuarial Guideline 49-A and 49-B. Compliance with those limits constrains how a policy may be illustrated; it does not make the illustrated result likely.

IUL policies carry cost of insurance charges, premium loads, administrative charges, and rider fees that increase with age and are deducted from policy value. Poor index performance, reduced or missed premium payments, increases in charges, or policy loans can cause a policy to underperform its illustration or to lapse, potentially resulting in loss of coverage and adverse tax consequences.

Policy loans and withdrawals reduce the cash value and death benefit and may create a taxable event, particularly if the policy lapses or is surrendered with an outstanding loan.

9. Tax Statements Are General

Any reference to tax treatment — including tax deferral, tax-free or tax-advantaged distributions, policy loans, 1035 exchanges, or the tax character of death benefits — reflects general information about current federal tax law as we understand it.

Tax law changes. Application depends entirely on your individual circumstances. State tax treatment may differ.

We are not tax advisers, accountants, or attorneys, and nothing on this Site is tax or legal advice. Consult your own qualified tax professional or attorney before acting.

Withdrawals of taxable amounts from an annuity are subject to ordinary income tax and, if taken before age 59½, may be subject to an additional 10% federal penalty tax.

10. The Contract Governs

No page, chart, illustration, guide, video, or conversation supersedes the policy contract.

The issuing carrier's contract and any attached riders and endorsements are the sole authority on all terms, benefits, guarantees, limitations, exclusions, charges, surrender provisions, and conditions of any product. In the event of any conflict between material on this Site and the contract, the contract controls.

Read the contract, the product disclosure, and the buyer's guide before purchasing.

11. Product Availability

Product features, index options, caps, participation rates, spreads, bonuses, riders, and availability vary by carrier, product, and state, and are subject to change without notice. Not all products or features are available in all states. Applications are subject to carrier underwriting and approval.

We offer products only in states where we are licensed and appointed with the issuing carrier.

12. Carrier Materials

Specific product illustrations are prepared and issued by the carrier, not by us, and are valid only as generated by the carrier for a specific applicant on a specific date with specific assumptions. We do not create, modify, or independently generate product illustrations.
